Marching Dogs Tesla Rentals - Liability Waiver

Required for all Tesla Cyberquad and Cybertruck for Kids Rentals

This waiver must be completed and signed by the individual renting the vehicle(s), who must be 25 years of age or older, and the legal parent or guardian of all participating riders. It outlines the responsibilities, safety terms, and liability release associated with the use of Tesla ride-on vehicles provided by Marching Dogs.

1. Assumption of Risk

I acknowledge that the use of battery-powered ride-on vehicles, including the Tesla Cyberquad and Cybertruck for Kids, involves inherent risks of injury, tipping, collision, or equipment failure. I voluntarily assume full responsibility for any injury or damage sustained as a result of participation, whether caused by rider action, environmental conditions, or equipment malfunction.

 

 

2. Release of Liability

In consideration for the rental and use of equipment provided by Marching Dogs LLC, I hereby release, waive, and discharge Marching Dogs LLC, its owners, agents, employees, and affiliates from any and all liability for claims of injury, illness, damage, or loss arising from or in connection with the use or misuse of the rented vehicle(s). This release applies to all claims, including those arising from negligence, with the sole exception of those resulting from gross negligence or willful misconduct.

 

 

3. Supervision & Usage Responsibility

I understand and agree that:

  • I am solely responsible for supervising all children operating the rented vehicle(s) during the entire rental period.
  • Only children ages 6–12 and weighing 150 lbs or less may operate or ride in the vehicle(s).
  • Riders must wear closed-toe footwear and helmet use is strongly recommended.
  • Vehicles may only be used on flat, dry, and even surfaces (e.g., pavement or level grass).
  • Use on mud, loose gravel, sand, water, steep terrain, or any off-road conditions is strictly prohibited.

These are children’s ride-on toys and do not feature suspension systems for aggressive use.

The following actions are strictly prohibited:

  • Towing, pulling, or hauling any object
  • Climbing, standing, or jumping on the vehicle
  • Tampering with or modifying the vehicle or electronics
  • Operating the vehicle without adult supervision
  • Moving or transporting the vehicle outside the approved event location

All Marching Dogs vehicles are tagged, serialized, and GPS tracked. Any unauthorized transport will result in forfeiture of deposit and may be grounds for legal action.

 

4. Damage & Deposit Policy

I understand that a refundable deposit of $500–$750 per vehicle is required and will be held via temporary authorization prior to the rental period. This deposit will be charged in full or in part if:

  • The vehicle is returned in damaged or unsafe condition
  • There is evidence of misuse, overloading, or terrain violations
  • The vehicle is not returned, or is returned without required components (charger, tag, etc.)

If a vehicle is returned beyond repair or deemed non-operational, I understand that I may be subject to additional charges beyond the deposit amount to cover replacement or damage-related expenses.

 

 

5. Medical Authorization & Liability for Injury

In the event of an accident or injury, I authorize emergency medical care for any child under my supervision. I understand and agree that Marching Dogs is not liable for any injuries sustained during the rental period, regardless of cause. All responsibility for injuries, treatment, and medical expenses lies solely with the undersigned guardian or supervising adult who has agreed to and signed this waiver.

 

 

6. Media Use & Photo Release

I grant permission to Marching Dogs to use any photographs or video footage taken during the rental period for marketing, promotional, and social media purposes. I understand that this content may be used publicly and waive any claim to compensation, rights, or approval.

 

 

7. Acknowledgment of Terms

By signing below, I affirm that:

  • I am 25 years of age or older and legally authorized to enter this agreement.
  • I have read and understood the Rental Policy, vehicle use guidelines, and this Waiver of Liability.
  • I accept full legal and financial responsibility for all participants and for the safe return and operation of the rented vehicle(s).
  • I understand that violation of the terms outlined above may result in immediate cancellation, loss of deposit, and additional fees.
